The debate around pets in rental properties is ongoing across the UK. While many landlords prefer a "no pets" policy for fear of damage or noise, increasing numbers of tenants see pets as part of the family. But is a blanket "no pets" clause always legally enforceable? The answer varies and is evolving.

  • England: Traditionally, landlords using Assured Shorthold Tenancies (ASTs) could include and enforce "no pets" clauses. However, the Renters (Reform) Bill currently progressing aims to change this, giving tenants the right to request a pet, which the landlord cannot unreasonably refuse. Landlords may be able to require pet insurance. Until this becomes law, existing clauses generally stand but may be seen as less favourable.
  • Scotland: Under the Private Residential Tenancy (PRT), there's no specific legislation banning "no pets" clauses. Landlords can include them. However, the 'reasonableness' of refusing a pet request might potentially be challenged at the First-tier Tribunal, though success isn't guaranteed for tenants. Enforcement often relies on the clause in the agreement.
  • Wales: The Renting Homes (Wales) Act uses standard Occupation Contracts. Similar to England's direction, the default position leans towards tenants being able to keep pets with landlord consent, which cannot be unreasonably withheld. Landlords can require specific conditions related to the pet. Existing contracts might have older clauses, but the trend is towards allowing pets reasonably.
  • Northern Ireland: Landlord and tenant law is less prescriptive on this specific issue. "No pets" clauses in tenancy agreements are common and generally enforceable unless deemed unfair under consumer protection law (which is a high bar).
